At Softinsa we recognise the importance of protecting your personal information and are committed to processing them responsibly and in compliance with the applicable data protection laws in all countries in which the IBM Group operates.
This Privacy Statement describes Softinsa’s general privacy practices that apply to the personal information we collect, use and share about consumers and other individuals among our customers, business partners, suppliers and other organisations with whom Softinsa has or may have a business relationship.
Why and how we collect and use your personal information
Softinsa may collect the User’s personal information as an individual for various purposes, such as:
Access and use of websites or other online services
When visiting one of our websites or using an online service, Softinsa will record the information required to provide you with access, for the operation of the website and for compliance with legal and security requirements relating to the functioning of the website, such as passwords, IP address and browser settings. We also collect information about the activities carried out by the User during the visit and to customise the website use experience, such as recording the User’s preferences and settings and collecting statistics to help Softinsa improve and develop our websites, products and services.

When the User contacts Softinsa (online or offline) within the scope of a request for information, to order a product or service or to provide support, or to participate in a forum or other social processing tool, we collect all information required to provide a response to the User’s request, to grant access to the product or service, to provide support and to contact the User. We collect, for example, the User’s name and contact information, order details and the agreement between the User and IBM to respond, send and bill the order, and we may include information from customer satisfaction surveys. We keep such information for administrative purposes, in defence of Softinsa’s rights, and within the context of our relationship with the User.
When the User provides the name and contact information to register in connection with such a request, the registration may be used to identify the User when visiting our websites.
Contact our customers’ employees, potential customers, partners and suppliers
Within the scope of the relationship between Softinsa and its customers or potential customers, partners and suppliers, business contact information is also provided (such as name, company contact details, position or function of its employees, contractors, consultants and authorised users) for contract management, response to requests, supply of products and services, provision of support, billing and services or relationship management purposes.
Softinsa records individual visits to our locations and facilities (name, identification and business contact information).
When it is indicated that Softinsa uses the User’s personal information within the context of an request, order, transaction or agreement (or for the preparation thereof), or to provide the user with services he/she requested (such as a website), that information is indicated because it is necessary for the execution of the agreement signed with the User.
When it is indicated that Softinsa uses the User’s personal information for marketing purposes, improvement or development of products or services, for security reasons, or for regulatory requirements outside the scope of the User’s agreement or request, this is done based on the legitimate interests of Softinsa or third parties or with the User’s authorisation. As a company of the IBM Group, Softinsa may share information about the User with IBM Portugal in accordance with this Privacy Statement.
Softinsa grants access to personal information only according to the need for knowledge, which is essential for the purposes for which such access is granted.
Where appropriate, Softinsa may also share personal information with selected partners to help us provide the User, or the company for which he/she works, products or services, or to respond to his/her requests, with the User’s authorisation. When selecting suppliers and partners, Softinsa takes into account the respective data processing processes.
Should Softinsa decide to sell, buy, merge or otherwise reorganise its activity in some countries, such transaction may involve disclosing personal information to buyers or potential buyers, or receiving such information from sellers. It is common practice for Softinsa to seek adequate protection for personal information in this type of transactions.
Under certain circumstances, personal information may be subject to disclosure to government agencies for court proceedings, court orders or legal proceedings. Softinsa’s objective is to protect the User’s personal information and maintain its accuracy. Softinsa implements reasonable physical, administrative and technical safeguards to protect the User’s personal information from unauthorised access, use or disclosure. For example, certain sensitive personal information, such as credit card information, is encrypted when it is transmitted over the Internet. Softinsa also requires its suppliers to protect such information from unauthorised access, use or disclosure.
Softinsa will not retain personal information any longer than necessary to fulfil the purpose for which it was processed, including the security of processing in compliance with legal and regulatory obligations (for example, audit, accounting and statutory retention terms), litigation regarding processing, and for the establishment, exercise or defence of legal proceedings in Portugal.
